📢 Policing Public Spaces: The Safe Spaces Act and LGBTQ+ Rights in the Philippines


Public spaces should be inclusive and safe for everyone. Under Republic Act No. 11313 (Safe Spaces Act of 2019), gender-based sexual harassment in streets, public places, and privately-owned spaces open to the public is explicitly prohibited. This:


❌  Homophobic, transphobic, and sexist slurs or statements

❌ Catcalling, leering, taunting, or unwanted advances

❌ Any acts that ridicule a person based on sex, sexual orientation, gender identity, or expression


The law empowers the Philippine National Police (PNP), MMDA, and local enforcers (with Gender Sensitivity Training) to act on complaints, with penalties ranging from fines to imprisonment depending on the offense and repetition.

While the Philippines continues to await a comprehensive national SOGIE Equality Bill, the Safe Spaces Act serves as a critical tool for protecting LGBTQ+ individuals in everyday public settings. Local government units have also enacted anti-discrimination ordinances that further strengthen these protections in specific areas.
